How to get excused from jury duty in Erie County, New York

The excusal routes Erie County, New York actually recognizes — what each one needs, who decides, and where it goes.

Erie does not decide financial hardship from anything you send in. The Commissioner of Jurors Office told this project by email on 28 August 2026 that there are two routes and only two: “everyone is entitled to a postponement of up to 6 months” — you simply say which month and week — or “during jury selection, you will have the opportunity to explain your situation to the attorneys or the judge when questioned. They may excuse you at that time based on your situation.” The office put the day at about 9 a.m. to 2 p.m. And that day is not wasted even if nobody excuses you: under NY Judiciary Law § 524, reporting in person counts as having served, which normally keeps you out of the pool for six years.

Financial hardshipRaised at jury selection, not in advance

Erie’s jury office says the choice is a six-month postponement, or coming in and explaining the situation to the attorneys or the judge during selection.

NY Judiciary Law § 517 and § 524. New York’s test is whether service would significantly compromise your ability to support yourself or your dependents, but Erie does not apply it on paper. Its Commissioner of Jurors Office states the two available routes plainly: a postponement of up to six months open to anyone, or explaining the situation “to the attorneys or the judge when questioned” during selection. Separately, § 524 makes a person who has served not competent to serve again for six years, and the Unified Court System counts reporting in person as serving.
